劳合社标准救助契约劳合社标准救助契约 【劳合社标准救助契约】被救助船船长代表被救各方与救助人之间签订的一种契约。在国际上被广泛采用，无效果、无报酬是其基本原则。传统的劳合社救助标准契约的主要内容有:救助人应尽力援救受难船员，船长以全权身份出面签约;救助报酬按无效果、无报酬原则由协商或仲裁确定;在被救助人提供担保前，救助人对被救助物有留置权;船长虽代表各方签订救助条约，但支付救助报酬的责任却为各自责任。1980年的劳合社公开格式对传统的契约进行了重大修改，对救助油轮和化学品船只时适用无效果、无报酬原则作了例外规定。即使救助不成功，或只是部分成功或救助受阻未能完成，油轮或化学品船只所有人也应支付给救助人员在救助中所支付的实际费用以及不超过该费用巧%的附加费，以鼓励救助人施救。随着1989年国际救助公约的修订，“劳合社救助契约”于1993年也有所调整。
