草地有偿家庭承包制草地有偿家庭承包制family contract system of public grassland eoodl youehangJ一ating ehengbaozhj草地有偿家庭承包制(family eontract system of publiegrassland)中国农牧区实行的草地生产经营制度之一。即按照草原法的规定，拥有草地所有权和使用权的单位，将全民所有、集体所有或集体长期固定使用的全民所有的草地，通过签订合同，规定期限和有偿费用，承包给家庭农牧户经营使用。在承包期间，承包者拥有草地管理、利用和建设的权利与义务，对外具有法人地位。这是20世纪80年代以来，中国草地管理经营中的改革成果之一。 中国草地生产经营体制几经变迁。1949年后在社会民主改革中，废除了草地私有制，实行了草地统一规划、划分使用的办法。在社会主义改造中，草地也随着合作社、人民公社、国营牧场或公私合营牧场的建立，划分给国营或集体生产单位使用。由于在草地经营体制上急于追求“一大二公”，超越了生产力发展水平，于是出现了“吃大锅饭”、“一平二调”等弊端，牧区草原普遍出现了开垦破坏、任意侵占、过牧退化、无人治理等问题，形成“草原无主、管理无法、破坏无罪”的现象。80年代以后，随着草原法的颁布和牧区经济法制改革的推行，草原牧业经营上实行了家畜户有户养或公有户养、比例分成和草地固定使用权、分户或联户承包经营等生产经营形式。经过多年的实践，已证明草地有偿家庭长期承包制是适应中国现阶段生产力发展的最好草地经营体制。 草地有偿家庭长期承包制的优点是:①在草地所有权和使用权固定给集体生产单位基础上，由集体生产单位把草地长期承包给家庭牧户管理、使用和建设，就把草地经营的权、责、利落到实处，从根本上克服了“吃大锅饭”的弊端。②承包经营草地的家庭牧户在承包期间拥有法人资格，可有效地贯彻实施草原法制。③草地长期固定给家庭牧户使用，可保证实施以草定畜、增草增畜的科学利用制度。④把草地建设的义务落实到家庭承包户，有利于推动草地生产力的提高与发展。⑤在游牧区，有利于牧户在长期承包的草地上建立冬春饲草饲料基地，建立定居的家庭牧场，改变少数民族游牧的生产生活方式。据1995年6月末统计，牧区草原实行家庭长期有偿承包的，已达到草原总面积的1/3以上。(李毓堂)
