《国家海域使用管理暂行规定》《国家海域使用管理暂行规定》national provisional regulations on management of use of the sea area guojia haiyu shiyong guanli zanxing gulding《国家海域使用管理暂行规定》(national provisional此即lations on Illall昭ement of use Of the sea~)国家海洋局和中华人民共和国财政部1993年5月31日联合发布的部门规章，并自发布之日起施行。其目的是适应海洋经济发展和对外开放政策的需要，合理开发利用海洋，使各种海洋产业协调发展，以实现社会、经济、环境效益的统一，对海洋开发利用活动实施综合性管理。 该暂行规定明确了海域属国家所有，指出使用国家海域从事生产经营活动的单位或个人，实行海域使用证制度和有偿使用制度。凡在中国内海、领海(包括水面、水体、海床和底土)的某一固定的海域范围内，从事排他性开发活动连续使用该海域3个月以上的使用者，应按规定要求，事先提出申请，经相应的人民政府批准并领取海域使用许可证。 使用国家海域从事生产经营活动的单位或个人，须按规定向国家缴纳海域使用金。海域使用金可以一次性缴纳，也可以按年度缴纳。因不可抗力遭受损失而无力缴纳者，可以申请减、免缴纳。海域使用金应全部上缴财政部门。其中30%上交中央财政，70%留归地方财政，作为中央财政和地方财政的预算固定收人。该项收人主要用于海域开发建设、保护和管理。(赵恩波)
