《城市规划法》与相关法律的衔接和协调 《城市规划法》主要与《土地管理法》、《环境保护法》有着密切的相互衔接和协调关系，城市规划部门、土地管理部门和环境保护部门应当密切配合，在各级政府的领导下，依法共同管好、用好城市土地，保护和改善城市生态环境，保障法律的顺利实施。 《土地管理法》第十六条规定：“在城市规划区内，土地利用应当符合城市规划”；第二十三条规定：“国家建设征用土地，建设单位必须持国务院主管部门或者县级以上地方人民政府按照国家基本建设程序批准的设计任务书或者其他批准文件，向县级以上地方人民政府土地管理部门提出申请，经县级以上人民政府审查批准后，由土地管理部门划拨土地。”《城市规划法》第三十一条就是对以上《土地管理法》涉及城市规划的条款作出具体的法律规定，进一步明确管理程序和分工，其主要内容是为了保障城市土地利用符合城市规划，在申请征用土地前期，必须向城市规划行政主管部门申请定点，由城市规划行政主管部门根据城市规划的要求，考虑城市现状、环境协调以及地上地下设施的限制等条件，核定建设用地的位置和范围，核发“建设用地规划许可证。”表明从规划的角度对建设用地定点的许可，这是城市人民政府有关城市土地使用决策的基本依据，是保证城市合理布局、合理用地、节约用地、实施规划的关键，充分体现了两个法律之间的相互衔接和协调。 《环境保护法》第二十二条规定：“制定城市规划，应当确定保护和改善环境的目标和任务。”第二十三条规定：“城乡建设应当结合当地自然环境的特点，保护植被、水域和自然景观，加强城市园林、绿地和风景名胜区的建设。”《城市规划法》第十四条则明确规定：“编制城市规划应当注意保护和改善城市生态环境，防止污染和其他公害，加强城市绿化建设和市容环境卫生建设，保护历史文化遗产、城市传统风貌、地方特色和自然景观”，同时其他条款还对实施规划过程中保证建设项目的合理布局、不得影响和破坏城市环境作出了明确规定。合理地制定和实施城市规划是防止城市环境遭受污染和破坏的重要前提。这两个法律相辅相成，是实现城市规划目标和环境保护目标的根本保证。
