知识产权的国际保护　　指国际上为了解决按照一个国家的国内法取得的专利、商标和版权等知识产权，只在该国领域内受到保护，在其他国家内不能发生法律上的效力的问题，而签订双边或多边条约，实现对知识产权的国际保护，以促进技术、知识的国际交流。　　　　专利、商标等工业产权方面的最重要的国际条约是1883年 3月20日签订的、目前已有92个成员国参加（迄1983年 3月15日止的数字）的《保护工业产权巴黎公约》。目前，以《巴黎公约》为中心在工业产权方面有13个条约或协定已经生效。它们是:《保护工业产权巴黎公约》，《制止产品来源虚假或欺骗性标记马德里协定》(1891)，《商标国际注册马德里协定》(1891)，《工业品外观设计国际保存海牙协定》(1925)，《商标注册用商品与劳务国际分类尼斯协定》(1957)，《保护原产地名称及其国际注册里斯本协定》（1958），《建立工业品外观设计国际分类洛迦诺协定》（1968），《专利合作条约》(1970)，《国际专利分类协定》（1971），《商标注册条约》(1973)，《保护植物新品种国际公约》（1961），《国际承认用于专利程序的微生物保存布达佩斯条约》(1977)以及《保护奥林匹克会徽的内华罗条约》。保护版权（又称著作权）方面的国际条约有：《保护文学艺术作品伯尔尼公约》(1886)，《世界版权公约》(1952)，《保护表演者、唱片录制者和广播组织国际公约》(1961)，《保护唱片录制者防止其唱片被擅自复制的公约》(1971)，《人造卫星播送载有节目信号公约》(1974)以及《避免对版权提成费双重征税的马德里多边公约》（见版权的国际保护）。　　　　上述条约或协定，除《世界版权公约》由联合国教科文组织管理外，其他都由世界知识产权组织管理或参与管理。世界知识产权组织是根据1967年在斯德哥尔摩签订的公约（于1970年生效）而成立的一个政府间组织，1974年12月成为联合国专门机构之一。该组织的宗旨是：①通过国与国之间的合作，并在适当情况下，与其他国际组织进行协作，以促进在全世界范围内保护知识产权。②保证各知识产权同盟间的行政合作。世界知识产权组织总部设在日内瓦。迄1983年3月15日止共有101个成员国。中国政府于1980年3月3日递交了加入书,于同年6月3日生效。
