专利专利patent国家主管专利的机关依照专利法，授予发明人在法律规定的期限内享有就该项发明进行制造、使用、销售和出口其产品的专有权。专利的有效期一般自提出申请日起或批准日起10～20年。专利不是靠自己的宣称所取得的，申请专利的条件是：①新颖性，即发明是世界上或本国内没有过的。②创造性，即发明的技术水平有突出的实质性特点和显著的进步。③实用性，即发明能够制造或者使用，并能产生积极的效果。专利的类型有：①发明专利。这是人们通过创造性脑力劳动创制或设计出的某种前所未有的东西，它是对某种技术问题的全新解决方案。中国的专利法规定，发明分为两种：一是具有新颖性、创造性、实用性的新产品发明；二是具有新颖性、创造性、实用性的新方法发明。②实用新型专利。这是对产品的形状、结构或者二者的组合作出的具有实用价值的新的技术方案的专利。把这种新方案应用于工业，可以制造具有使用价值或实际用途的产品。③外观设计专利。这是对产品的形状、图案、色彩或者三者的组合作出的富有美感而又具有实用价值的新设计授予的专利。对这一专利进行保护，能够促进产品式样的不断改进。从法律角度来看，专利是专利权的简称，它表现为发明人经申请批准获得的财产独占权。取得专利权的人即为专利权人。专利权包括：非经专利权人同意，其他人不得制造和销售专利产品，或使用专利方法；如他人要使用某项专利，就要取得专利占有者的许可并付给一定报酬，承担一定的义务；如他人侵犯，则要受到法律的追究。专利权是一种具有地域性，在一个国家或地区批准的专利，仅在那个国家或地区有效；任何一个国家批准的专利，都只适用自己国家的专利法。没有任何一个国家是根据外国专利法产生本国的专利权的。
