法国公务员服务与惩戒法国公务员服务与惩戒  法国公务员服务与惩戒根据法国公务员法的规定,公务员负有服从一般法令及上司职务上命令之义务。法国政府并规定公务员应适合公共利益,以执行公务;执行职务并应服从法令,以公正、超然、中立的立场,专心于公务的执行。公务员有廉洁奉公、保守公务机密的义务,但在法院得为其作证。法官及军官均禁止参加政治活动,但对一般公务员则无明文限制,可同普通公民一样,自由发表政治意见,对公职选举也可参加竞选。公务员可以参加政党,即令是反对党,也可自由参加。依官吏法规定,公务员必须遵守下列各项:①须亲自有效的尽职,非在特别规定下,不得委托他人代理。②须遵守既定规则,不得废驰或间断其工作及无故缺席迟到。③不得兼营其他职业或商业;亦不得有其他营利活动。但从事农业,制作科学的、文学的或艺术的作品,为鉴定、论断或辩论者,经核准从事于所掌事项之研究,教育机关或美术行政机关之技术或科学人员从事于职务性之自由职业者等均除外。④须保守公务机密,并不得擅自辞职。⑤须服从长官命令,遵守一切法律与纪律。⑥公务员之配偶从事营利活动者应报请备案。惩戒系对违法失职者所给予的处分,除本着“刑先惩后”之原则办理外,各机关首长对惩戒有实际之权力。惩戒分为两种:一是精神上的惩戒(较轻的惩戒),如申诫、警告、记过等是由机关首长决定的。二是实质上的惩戒(较重的惩戒),如减薪、降级、停升(即从晋升候用名册中除名)、免职等。此项惩戒须依照一定的法律程序,由惩戒机构(各机关惩戒委员会)或行政法院作最后的处置。各机关惩戒委员会的意见不能够拘束机关首长。两者之间意见不同时,得向“公务员高级协议会”申诉促成协调,机关首长仍可坚持其决定。公务员违反纪律,由行政部门处理。纪律处分属于享有任命权的机关,但必须在与惩戒机构内的对等行政委员会协商后才能行使。法国政府对公务员处分的种类分为:警告,训戒,取消一次晋升资洛,减薪,降职,调动工作,降级,临时解除职务(不超过6个月),强制退休,保留领取退休金权利的撤职,停止领取退休金权利的撤职。为保障被处分者的利益,在惩戒处分前,受惩戒者得提出答辩或请证人代为辩护,受惩戒者如不服处分,得上诉于评政院作最后决定。
