公开拍卖土地使用权公开拍卖土地使用权 【公开拍卖土地使用权]政府主管部门和土地购买者，在指定的地点和时间，当众进行某块土地的拍卖，竞投者通常举着统一编号的牌子应价，一般情况下是出价最高的竞投者获得土地的使用权。公开拍卖是土地使用权有偿出让的一种主要形式，其主要程序如下:1.政府土地主管部门通过新闻媒介等方式，提前公告出让地块的地点、用途、面积及拍卖土地的地点、时间等一些有关事宜。2.在规定的地点、时间，由政府土地使用权拍卖主持人(通常是土地管理人员)主持公开拍卖活动。拍卖主持人当场宣布拍卖底价，并且根据应价喊出每一口加价金额，由用地单位举牌应价竞争，最后与应价最高者当场成交。3.成交者应该按《土地使用规划》与政府土地主管部门鉴订《土地使用合同书》，并且交纳履约保证金，在规定时间内交付全部款项，所交保证金可抵付地价。公开拍卖这种方式主要适用于金融业、商业、房地产业等一些竞争性强、盈利率高的行业。公开拍卖土地使用权为国家控制的一级土地市场，出让的只是土地使用权。土地使用权公开拍卖后，用地者必须按照与土地所有者鉴订的合同要求使用土地，出让是有偿、有期限的。
