超额赔款再保险合同的特殊条款超额赔款再保险合同的特殊条款 I超额赔款再保险合同的特殊条款】1.恢复(Reinstatement)条款。在某些合同中，特别是在承保巨灾危险合同中，往往有条款规定，一年中保险人只负责一个或两个限额的赔款。如一个超额赔款合同规定每次事故赔款超过10万元时，由再保险人负责赔付到40万元;当再保险人赔款的总数达到40万时，它的第一次责任已经终了。但保险人一般都希望继续取得保障，因此超赔合同往往规定有“恢复条款”，规定在再保险人赔足40万元最高额后，合同可自动恢复，继续有效，由再保险人负责另一次的损失责任，但保险合同如果规定有恢复责任，必须由保险人按规定加付保费，一般在赔足第一次限额后，加付的保费按恢复时间乘以费率计算，有的则规定再交一次保费，不论损失时间。 如果费率是以损失成本为基础的调整幅度费率，保障一般对损失次数无限制，因为每次赔款支付会使费率自动增加直至达到最高费率。 对于一般承保超额赔款(耳、永 ingC~，orunde舀吊tingCover)，台湾译为运营超额赔款，在一年期内通常不限制赔款次数。即一年中无论发生几次赔款，合同均要负责，它的性质，类似于溢额分保，当然每一个风险和每次事故赔款数字最高到达限额为止。但当超赔分为两层时，第二层可能应用恢复两次或三次，但须按比例加付保费。对巨灾超额赔款，英国、欧洲其他国家和美国的实际做法都限制一次恢复，加付保费。有些保险人愿意适当地提高期初的保费而取得恢复一次，不再增加保费，使保费固定化。 如果合同没有包含表明恢复规定，这就需要明确它是否允许无限次数的自由和自动恢复或者它只是表明在先不允许任何自动恢复，即保障限制一次补偿而任何一次补偿或几次补偿的累积数字达到合同最高限额时，都要由双方在损失发生时协议增加保费，才能恢复。 在多数情况下，恢复保费不论恢复责任的时间都要按100%计算，恢复数额按损失补偿数字与恢复的数字比例计算;如果加费是按“时间和期限两间的比例”计算，方法如下: 期限:1.1.12个月 限额:超过1(X刀刃元以后的粼刃仪X)元 年保费:5以X旧 赔款:1《洲XX) 损失A:2月1日 ~~，。.‘.J_‘，~.“‘，5侧义幻 恢复保费:n43 .84即:1《XX幻x共黑杀x 口、~沙洲“‘~’~~’‘““““‘、粼X众幻‘、334365损失B:12月一1日恢复保费:106.16即:1，x湍、盖 两种方式之所以在保费数字上有不同，主要是在于损失日期，如果在年中发生损失，加费将为50%。
