新自然法学派 又称复兴自然法学派。在西方法学著作中，对该派含义有不同理解。广义泛指19世纪末以后出现的自然法（见古典自然法学派）或类似自然法的学说。从这一意义上讲，自19世纪末直到20世纪70年代的所有自然法或类似自然法的学说，从天主教神学的新托马斯主义法学派和非神学的、世俗的自然法学说，都称为新自然法学派。狭义指自19世纪末以来，特别是第二次世界大战以后兴起的非神学的自然法学说。 自19世纪初开始,自然法思想长期处于衰落状态,实证主义法学占有压倒优势。19世纪末20世纪初，开始出现新的自然法学说。如法国法学家J.夏蒙(1859～1922)等人提倡"复兴自然法"，要求个人权利和社会权利在理性和正义的制度下相互结合。又如德国法学家、新康德主义法学派创始人R.施塔姆勒提出了"内容可变的自然法"的学说。有的法学著作甚至将L.狄骥的社会连带关系学说也解释为自然法理论的一种体现。这些新自然法学说与17、18世纪古典自然法学说显然不同。古典自然法学派主张反抗暴政，认为自然法永恒不变；而新自然法学派主张阶级调和，自然法内容可变，等等。第二次世界大战后，随着法西斯政权的崩溃，否认正义之类价值准则的实证主义法学相形失色，强调实在法应从属正义之类价值准则的自然法学说则进一步兴起。主要代表人有美国法学家L.L.富勒等。富勒的学说主要论证程序自然法：将法律不溯既往等民主原则称为法的内在道德；强调实在法与价值准则、法与道德是不可分的。 60年代至70年代初，美国国内政治动荡，各种群众运动兴起，在这种历史条件下，美国当代学者提出了新的自然法学说，主要有J.B.罗尔斯和R.M.德沃金。
