条约的解释 因缔约国对约文内容理解不同、从而影响到条约的执行时所进行的解释。它涉及两个问题:①由谁解释,②按照什么规则进行解释。 缔约国解释或交付仲裁 条约在原则上应由缔约国解释。如果缔约国在解释上发生分歧，一般应由双方通过友好协商、和平谈判加以解决。如果分歧仍不能解决时，现代的一些国际公约多规定有条约解释的条款和因解释产生争端的解决程序，例如1970年《关于制止非法劫持航空器的公约》第12条和1971年《关于制止危害民用航空安全的非法行为的公约》第14条均规定："如两个或几个缔约国之间对本公约的解释或应用发生争端而不能以谈判解决时,经其中一方的要求,应交付仲裁。如果在要求仲裁之日起6个月中,当事国对仲裁的组成不能达成协议,任何一方可按照《国际法院规约》,要求将争端提交国际法院"，但"每个国家在签字、批准或加入本公约时，可以声明该国不受前款规定的约束"。1980年9月10日中国在加入两公约时，即作了此项声明。 条约解释的规则 按《维也纳条约法公约》（见条约）有关条文，其要点为：①条约应依其用语按其上下文并参照条约的目的及宗旨所具有的通常意义，善意解释之。②上下文除指连同序言及附件在内的约文外，还应包括全体当事国因缔结该项条约所订的有关协定，以及一个以上当事国因缔结条约所订并经其他当事国接受为条约有关文件的任何文件。应与上下文一并考虑的还有：当事国后来所订有关条约解释或其规定之适用的任何协定，嗣后在条约适用方面确定各当事国对条约解释之协定之任何惯例，以及适用于当事国间关系的任何有关国际法规则。如当事国愿意使条约用语具有特殊意义，则可从此特殊意义。③为了证实按照上述办法所作之结论，或按照上述办法所作结论仍然意义不明、难解、显然荒谬或不合理时，可以使用解释的补充资料，包括条约的准备工作及缔约的情况在内。④如果一个条约是以两种或两种以上文字写成，除条约规定应以某种文本为准外,各种文字的文本同一作准。1958年1月12日中国与也门王国的友好条约规定，中文和阿拉伯文"两种文本具有同等效力,在解释上有分歧的时候,以阿拉伯文本为准"。这种规定反映了中国对第三世界国家的尊重。⑤作准文字以外的以其他文字作成的条约译本，一般不是作准文本，但如条约有此规定或当事国有此协议时，可作例外。⑥条约用语在各作准文本内应推定意义是相同的。⑦两种以上文字同一作准的条约，没有规定以某种文字为解释的根据者，如遇解释分歧而且按照上述办法不能消除分歧时，应采用符合条约的目的及宗旨而又最能调和各文本的意义。
