井田制井田制中国古代的一种土地制度。“井田”一词,最早见于《谷梁传·宣公十五年》:“古者三百步为里,名曰井田。”夏代曾实行过井田制。商、周两代的井田制因夏而来。井田制在长期实行过程中,从内容到形式均有发展和变化。井田制大致可分为八家为井而有公田与九夫为井而无公田两个系统。记其八家为井而有公田者,如《孟子·滕文公上》载:“方里而井,井九百亩。其中为公田,八家皆私百亩,同养公田。公事毕,然后敢治私事。”记其九夫为井而无公田者,如《周礼·地官·小司徒》载:“乃经土地而井牧其田野,九夫为井,四井为邑,四邑为丘,四丘为甸,四甸为县,四县为都,以任地事而令贡赋,凡税敛之事。”当时的赋役制度为贡、助、彻。助即服劳役于公田,贡为缴纳地产实物。周行彻法,当为兼行贡、助两法。结合三代赋役之制来分析古时井田之制的两个系统,其八家为井而有公田、需行助法者自当实行于夏、商时期。其九夫为井而无公田者当始实行于周代。周代行助法地区仍沿用八家为井之制,惟改私田、公田之数为百亩;而行贡法地区则将原为公田的一份另分配于人,故有九夫为井之制出现。古时实行易田制(即轮耕制),一般是不易之地家百亩,一易之地家二百亩,再易之地家三百亩。以上所说井田之制,当为在不易之地所实行者,是比较典型的。至于在一易之地、再易之地等如何以井为耕作单位进行区划,已无法推知,井田之间立五沟五涂之界以便划分土地和进行生产。井田制由原始氏族公社土地公有制发展演变而来,其基本特点是实际耕作者对土地无所有权,而只有使用权。土地在一定范围内实行定期平均分配。由于对夏、商、周3代的社会性质认识各异,各家对井田制所属性质的认识也不相同,或以为是奴隶制度下的土地国有制,或以为是奴隶制度下的农村公社制,或以为是封建制度下的土地领主制,或以为是封建制度下的家族公社制或农村公社制。但在承认井田组织内部具有公有向私有过渡的特征,其存在是以土地一定程度上的公有作为前提这一点上则认识基本一致。夏、商时期实行的八家为井、同养公田之制,公有成分更多一些。周代以后出现的九夫为井之制个人私有的成分已增多,可以看作私田已被耕作者占有。西周中期,贵族之间已有土地交易,土地的个人私有制至少在贵族之间已经出现。由此,自上而下,进一步发展为实际耕作者的土地个人私有制。《农政全书》所绘“屋三为井”示意图战国时期,秦国商鞅变法,“为田,开阡陌”,推行土地个人私有制。至此,井田制彻底瓦解。秦、汉以后,实行井田制的社会基础已不复存在,但其均分共耕之法对后世的影响却极为深远。历代鼓吹井田思想者不乏其人。汉时董仲舒、师丹等提出的限田制,王莽时实行的王田制,西晋时实行的占田制,北魏和隋、唐时实行的均田制等,也都渊源于井田思想。宋、元以后,大土地所有制确立。虽然还有人继续鼓吹井田思想,但与其相类的方案已不可能在大范围内推行,而只能在小范围内短时间存在。
